The mark consists of a sound mark comprising a music sequence in the key of a minor in 4/4 time, playing the notes in the transcription shown in the drawing filed herewith. The motive consists of a synthesizer arpeggiation followed by a piano beginning with a low A for a sixteenth note going into an A and high E for a dotted eighth to a high C for a quarter note, down a third to A for an eighth, down a second to dotted eighth G, up a fourth to C, ending back down on a G eighth. The same succession of notes and rhythm repeats itself except ends on an A eighth, then the next beat begins on a high G, down a fourth to a D, down a third to B, down another third to G, back up a fifth to D, and down a third to B. In the last beat, the first half of the motive repeats starting on a high E, down to C, A, but ends on an A quarter note an octave higher. Simultaneously with the piano motive, there is a guitar accompanying with an a minor chord, and horns in F and violins accompanying the progression with a minor, to G major, ending back on an a minor chord, with a viola, violoncello, and contrabass also coming in with a minor and G major chords on the fourth to sixth beats. An electric bass comes in on the third beat with a dotted quarter note in A followed by sixteenth notes E, D, A, G, to a dotted quarter note F, to quarter notes D, F, to G dotted quarter note to quarter notes E, G, ending on dotted quarter note A. The sequence increases in volume as it is played.
