(1) The geographic area in which the applicant is using the mark in commerce is Pinellas County, Florida, and applicant claims the exclusive right to use the mark in an area comprising the entire United States except Orange County, Florida and Seminole County, Florida. (2) The applicant's services are bar and restaurant services; (3) The applicant seeks registration without any restriction on the mode of use; (4) The concurrent user's name and address is July Eight LLC, 1042 N Mills Avenue, Orlando, FL 32803; (5) Applicant is unaware of any registrations issued to or applications filed by the concurrent user; (6) Upon information and belief, the concurrent user may be using the mark in commerce in Orange County, Florida at 1036 N Mills Ave, Orlando, FL 32803; (7) Upon information and belief, the concurrent user's services may be bar services; (8) Upon information and belief, the concurrent user's mode of use is a stylized logo within a pentagram formed by swords within a circle and used in conjunction with bar services for a patio bar. (9) Upon information and belief, the time periods of such use by the concurrent user may be since at least as early as October 9, 2015.
