Design Mark
The mark consists of The Applicant's Amended Description of the Mark follows. For purposes of clarity and readability, the Amended Description of the Mark appears in a formatted PDF document which submitted in the evidence field of this electronic filing. The Applicant is not claiming color as a feature of the mark. The mark consists of a three dimensional configuration of a table utensil neck. Broken lines extending rearwardly from the table utensil neck represent table utensil handle structures, and such broken lines form no part of the claimed design. Broken lines extending forwardly from the table utensil neck represent a table utensil working head, and such broken lines form no part of the claimed design. The mark is a three-dimensional configuration of a specific design feature of the table utensil neck, the specific design feature comprising a gabled appearance of the left and right sides of the table utensil neck. The elements of the drawing that constitute the mark are set forth in subsections (a), (b), (c), and (d), immediately following: (a) the solid line extending along the upper right edge of the table utensil neck; (b) the solid line below the line described in section (a) above; (c) the solid line to the left of the line described in section (a) above; and (d) neck surfaces between the lines described in sections (a), (b), and (c) above. The left wall of the table utensil neck is a mirror image of the neck's right wall which faces the viewer of the drawing. Each of the elements described in subsections (a), (b), (c), and (d) above is claimed as part of the mark. Elements in the drawing that are not a part of the mark are set forth in subsections (a) and (b) immediately following: (a) a dashed line table utensil handle extending rearwardly from the table utensil neck; and (b) dashed line table utensil working head extending forwardly from the table utensil neck. The matter of the drawing shown in broken or dotted lines is not part of the mark.
