Design Mark
The mark consists of Applicant is submitting one specimen for the class showing the mark as used in commerce on or in connection with any item in the class, consisting of: a figure in the general form of a shield, trimmed with an outside black border, with a white border inside it, and a blue border inside of the narrow white border. The top of the figure slopes slightly upward from the left to center in a rounded peak and then slightly downward to the right top corner; the border on each side goes downward and slightly outward, then inward and outward in a semicircle then curves down and inward meeting at the bottom in a rounded point. The word, DIABETIC" in bold letters and blue coloring is printed across the center of the image. In the bottom fourth of the image is contained a pictorial depiction of a syringe in black color. Below that are the words "med-Ecase" in black color. Within the upper one third of the figure is a light blue background figure in a modernistic depiction of a person in motion carrying a container; a circle on the upper right depicts the head; the arm on the right curves upward; the arm on the left curves downward; the arm on the left holds a light blue container, on which there is a white colored cross with a red border and with the cross rotated forty-five degrees; lower-case red letters "epp" are in the center of the figure, with the letters slightly offset, having the middle letter slightly lower than the other letters, and these letters are separated from the blue background with a strip of white-collar to set the letters apart for easier reading blue figure in the modernistic shape of a figure and lettering. Underneath, and across the bottom part of that figure, are the words "essential preparedness products" in black color. The applicant claims no independent rights to any of the individual words "essential", "preparedness," "products" or "diabetic" or any independent claim to any depiction or symbol of a syringe.
