The mark consists of a three dimensional configuration of the goods, namely a hoist. The construction of the hoist is claimed, exactly as shown, including: an elongated polygon having a hook element extending from a top end thereof and a eyelet extending from a bottom end thereof; a first pair of concentric circles and a second pair of concentric circles located within the elongated polygon and arranged vertically spaced and horizontally offset from one another; a first closed-perimeter shape located within the elongated polygon adjacent the first pair of concentric circles, the first closed-perimeter shape generally tapering in width moving upward and away from the first pair of concentric circles, a second closed-perimeter shape located within the elongated polygon and extending from a position adjacent the first pair of concentric circles and the second pair of concentric circles, the second closed-perimeter shape generally tapering in width moving from the first pair of concentric circles to the second pair of concentric circles; a generally rectangular arm extending obliquely from a side of the elongated polygon; and an arc extending from a lower side of the generally rectangular arm to the side of the elongated polygon. Any matter shown in broken or dotted lines in not part of the mark and serves only to show position or placement of the mark.
