Request for Amendment of Trademark Application to Seek Concurrent Use Registration Applicant, through its attorney, hereby requests that its Application to register the above-referenced mark be amended pursuant to Trademark Rule 2.73, 37 C.F.R. § 2.73, to seek concurrent use registration. Pursuant to Trademark Rule 2.42, 37 C.F.R. § 2.42, Applicant requests that its Application be amended to seek registration under the following conditions: Subject to Concurrent Use Proceeding with Registration No. 3716781. Applicant claims the exclusive right to use the mark in the area comprising all of the United States of America except for the states of Colorado and Washington. Further pursuant to Trademark Rule 2.42, applicant states that, to the extent of its knowledge, applicant is aware of the following concurrent user of the above mark: Name and address of Concurrent User: Baroness Small Estates, Inc., a corporation of Colorado, 2395 West 2nd Avenue, Denver, Colorado 80223, United States Registrations and applications for mark owned or filed by Concurrent User: U. S. Registration Number: 3716781; Registration Date: Nov. 24, 2009 Geographic Area of Concurrent User's Use: The States of Colorado and Washington. Mode of Concurrent User's use of the Mark: Applicant is informed and believes that the mark is used on labels on wine bottles, and in related advertising and promotion materials.
