Design Mark
The mark consists of the configuration of a cylindrical bottle with a indented parallel ribs and decorative wave pattern of raised bumps within a raised curved design. Although the container is functional, the ribs and the design on the bottle serve no utilitarian purpose and were designed as a part of the products trade dress to create a distinctive appearance for the bottle which will distinguish it from the many other bottles that are in the market place containing beverage products. Such design should be available to manufactures as trademarks.
